Der vorliegende Text ist der Versuch einer Dekonstruktion der herrschenden ideologischen Annahmen des gegenwärtigen Corona-Diskurses. Er ist der Versuch, diese ideologischen Gedankengänge in ihrer Mangelhaftigkeit darzustellen und ihren ideologischen Charakter zu benennen, sohin der Versuch eines Nachvollzugs des herrschenden Nachdenkens über Corona. Dieses herrschende Nachdenken über Corona und dessen Fortgehen von der einen ideologischen Annahme zur nächsten können als Metamorphosen des pandemischen Bewusstseins bezeichnet werden. Seinen Ausgangspunkt nimmt das pandemische Bewusstsein bei der Diagnose des krisenhaften Charakters der gegenwärtigen Gesellschaft, dem (...) es eine „alte Normalität“ entgegenimaginiert. Hier betreibt es eine Rechtfertigung des alten, in dessen Krisencharakter jedoch nicht durchschauten, Zustandes der Gesellschaft. In Sehnsucht nach der Idylle der präpandemischen Gesellschaft entwirft es eine „solidarische“ Gemeinschaft gegen die Bedrohung durch einen äußeren Feind und konstituiert sich also negativ als homogenes Ganzes. Seine Sehnsucht wird zur Harmoniebedürftigkeit im Hier und Jetzt, die es sich durch seinen Glauben an die gute Herrschaft zu stillen weiß, wenn es sich über die Unverhältnismäßigkeit der staatlich verordneten Corona-Maßnahmen echauffiert. Dabei fühlt es sich durch den staatlichen Appell an den gesunden Menschenverstand im täglichen Umgang mit Corona bestätigt und lauscht in aufklärerischem Ethos seiner ewigen Vernunftfähigkeit. In dialektischer Akrobatik veranstaltet es das pandemische Bewusstsein, in der Isolation eine neue Form der Solidarität, das Glück im Unglück zu entdecken, ohne zu erkennen, dass es damit seine Rückkehr zum „Normalzustand“ der bürgerlichen als einer warenproduzierenden Gesellschaft vollzogen hat. Mit gutem Gewissen enthält es sich eines kritischen Urteils über die Corona-Krise und resigniert staatstreu vor der Einsicht in die Wirklichkeit. So lässt es sich gut regieren. (shrink)

A legal critique that ties up to Pashukanis focuses not on the content of law, but on the specific form in which societal relations are conveyed. In analogy to Marx’s theory of value-form, Pashukanis unfolds a theory and critique that captures the specific way in which people relate to each other within the so called civil society. The concept of legal subjectivity becomes the scene of a dialectics of freedom and domination which unfolds in the interplay between obfuscation and reality. (...) Doubt is a much-maligned state. We are racked by doubts, tormented by doubts, plagued by them, paralysed. Doubts can be troubling, consuming, agonising. But however ill-regarded is doubt, anxiety is more so. We recognise the significance of doubting in certain contexts, and allow ourselves to be guided by our doubts. For example, the criminal standard of proof operative in the U.K., U.S., as well as in most other anglophone countries, Germany, Italy, Sweden and Israel, requires for conviction to be permissible (...) that the defendant’s guilt is proved beyond reasonable doubt; to feel a doubt about a defendant’s guilt, so long as it is reasonable, is reason to refrain from convicting. But our folk understanding of anxiety ascribes no value to that state. Anxiety is inherently unpleasant and irrational; it prevents us from being able to perform well when it is most important to us that we do; it is an emotion that, if we could, we’d eliminate from our emotional toolbox. Yet in this thesis, I offer a vindication of doubt – a defence of doubt in terms of what it does for us – on which it ultimately turns out to be a kind of anxiety. The basic idea is that the concept of doubt serves a function for us that we couldn’t do without: it signals when we should begin inquiry. I will argue that the concept doubt is able to serve this function because the state it picks out, the state of doubt, is a kind of anxiety: epistemic anxiety. I develop a picture of epistemic anxiety as an emotional response to epistemic risk: potential disvalue in the epistemic realm. Because doubt is a kind of anxiety, it has the right kind of representational and motivational profile to track epistemic risk in our environments, and motivate us to reduce or avoid that risk. This makes it hugely valuable for us, as knowledge-seeking creatures, given the incompatibility of knowledge with high levels of epistemic risk. (shrink)

In this paper, I provide an account of epistemic anxiety as an emotional response to epistemic risk: the risk of believing in error. The motivation for this account is threefold. First, it makes epistemic anxiety a species of anxiety, thus rendering psychologically respectable a notion that has heretofore been taken seriously only by epistemologists. Second, it illuminates the relationship between anxiety and risk. It is standard in psychology to conceive of anxiety as a response to risk, but psychologists – very (...) reasonably – have little to say about risk itself, as opposed to risk judgement. In this paper, I specify what risk must be like to be the kind of thing to which anxiety can be a response. Third, my account improves on extant accounts of epistemic anxiety in the literature. It is more fleshed out than Jennifer Nagel’s, which is largely agnostic about the nature of epistemic anxiety, focusing instead on what work it does in our epistemic lives. In offering an account of epistemic anxiety as an emotion, my account explains how it is able to do the epistemological work to which Nagel puts it. My account is also more plausible than Juliette Vazard’s, on which epistemic anxiety is an emotional response to potential threat to one’s practical interests. Vazard’s account cannot distinguish epistemic anxiety from anxiety in general, and also fails to capture all instances of what we want to call epistemic anxiety. In a contribution to a symposium on xenophilia, this essay — a study of Brian Friel’s 1980 play Translations — raises the question of whether all xenophilia is by nature doomed to fail. Set in Ireland in 1833, the drama centers on the tension arising from a young British lieutenant’s falling in love with an Irish-speaker while he is in her country to translate Irish place-names into English for an imperial cartographic survey. While the lieutenant is referred to in the (...) play as a Hibernophile, the essay interprets his love as xenophilic: love for the foreignness rather than the Irishness of what he encounters. The lieutenant’s love of foreign places and their names impedes his effort to systematize Ireland for imperial ends, and his love for an Irish woman brings about his own undoing. Applying Simone de Beauvoir’s view of alterity to the lieutenant’s xenophilia, the essay questions whether the English written over the Irish in this play and the lieutenant’s desire written over the objects of his love obscure enough of the other’s otherness to render his xenophilia no longer viable. The key question addressed in this volume is the function of knowledge in the production and reception of literary texts. Literary studies on works from different national literatures and periods are supplemented by insightful contributions from history, linguistics and philosophy, illuminating the discussion for the first time from a multilayered perspective.".

This paper evaluates whether and to what extent modal constraints on knowledge or the semantics of ‘knows’, which make essential reference to what goes on in other possible worlds, can be considered non-epistemic factors with epistemic significance. This is best understood as the question whether modal factors are non-truth-relevant factors that make the difference between true belief and knowledge, or to whether a true belief falls under the extension of ‘knowledge’ in a context, where a factor is truth-relevant with respect (...) to S’s belief that P iff it bears on the probability that P is true. To the extent that these factors are non-epistemic, epistemologies that endorse them—modal epistemologies—stand in conflict with intellectualism. I focus on three modal epistemologies: safety, sensitivity, and David Lewis’s epistemic contextualism. I argue that prima facie, safety and sensitivity allow that non-epistemic changes in a context can shift the closeness ordering on worlds, and in so doing make a difference to whether S knows P, while Lewis’s contextualism allows that non-epistemic changes in a context can shift the relevant domain of not-P possibilities that must be eliminated for ‘S knows P’ to be true in that context. Then to make her theory compatible with intellectualism, the modal epistemologist must say much more about the notion of probability at play in the definition of ‘truth-relevant’. I suggest that either accepting or rejecting that modal epistemologies are intellectualist has significance consequences for debates between pragmatists and purists, which radiate into wider contemporary epistemology. Citizenship presents two faces. Within a political community it stands for inclusion and universalism, but to outsiders, citizenship means exclusion. Because these aspects of citizenship appear spatially and jurisdictionally separate, they are usually regarded as complementary. In fact, the inclusionary and exclusionary dimensions of citizenship dramatically collide within the territory of the nation-state, creating multiple contradictions when it comes to the class of people the law calls aliens--transnational migrants with a status short of full citizenship. Examining alienage and alienage law (...) in all of its complexities, The Citizen and the Alien explores the dilemmas of inclusion and exclusion inherent in the practices and institutions of citizenship in liberal democratic societies, especially the United States. In doing so, it offers an important new perspective on the changing meaning of citizenship in a world of highly porous borders and increasing transmigration. As a particular form of noncitizenship, alienage represents a powerful lens through which to examine the meaning of citizenship itself, argues Linda Bosniak. She uses alienage to examine the promises and limits of the "equal citizenship" ideal that animates many constitutional democracies. In the process, she shows how core features of globalization serve to shape the structure of legal and social relationships at the very heart of national societies. (shrink)

Visible Identities critiques the critiques of identity and of identity politics and argues that identities are real but not necessarily a political problem. Moreover, the book explores the material infrastructure of gendered identity, the experimental aspects of racial subjectivity for both whites and non-whites, and in several chapters looks specifically at Latio identity.

Three philosophical accounts of risk dominate the contemporary literature. On the probabilistic account, risk has to do with the probability of a disvaluable event obtaining; on the modal account, it has to do with the modal closeness of that event obtaining; on the normic account, it has to do with the normalcy of that event obtaining. The debate between these accounts has proceeded via counterexample-trading, with each account having some cases it explains better than others, and some cases that it (...) cannot explain at all. In this article, we attempt to break the impasse between the three accounts of risk through a shift in methodology. We investigate the concept of risk via the method of conceptual reverse-engineering, whereby a theorist reconstructs the need that a concept serves for a group of agents in order to illuminate the shape of the concept: its intension and extension. We suggest that risk functions to meet our need to make decisions that reduce disvalue under conditions of uncertainty. Our project makes plausible that risk is a pluralist concept: meeting this need requires that risk takes different forms in different contexts. But our pluralism is principled: each of these different forms are part of one and the same concept, that has a ‘core-to-periphery’ structure, where the form the concept takes in typical cases (at its ‘core’) explains the form it takes in less typical cases (at its ‘periphery’). We then apply our findings to epistemic risk, to resolve an ambiguity in how ‘epistemic risk’ is standardly understood. (shrink)

In the field of art history, the white Western male viewpoint, unconsciously accepted as the viewpoint of the art historian, may—and does—prove to be inadequate not merely on moral and ethical grounds, or because it is elitist, but on purely intellectual ones. In revealing the failure of much academic art history, and a great deal of history in general, to take account of the unacknowledged value system, the very presence of an intruding subject in historical investigation, the feminist critique at (...) the same time lays bare its conceptual smugness, its meta-historical naïveté. At a moment when all disciplines are becoming more self-conscious, more aware of the nature of their presuppositions as exhibited in the very languages and structures of the various fields of scholarship, such uncritical acceptance of “what is” as “natural” may be intellectually fatal. Just as Mill saw male domination as one of a long series of social injustices that had to be overcome if a truly just social order were to be created, so we may see the unstated domination of white male subjectivity as one in a series of intellectual distortions which must be corrected in order to achieve a more adequate and accurate view of historical situations. Abstract:This field survey focused on two constructs that have been developed to represent the ethical context in organizations: ethical climate and ethical culture. We first examined issues of convergence and divergence between these constructs through factor analysis and correlational analysis. Results suggested that the two constructs are measuring somewhat different, but strongly related dimensions of the ethical context. We then investigated the relationships between the emergent ethical context factors and an ethics-related attitude (organizational commitment) and behavior (observed unethical conduct) for (...) respondents who work in organizations with and without ethics codes. Regression results indicated that an ethical culture-based dimension was more strongly associated with observed unethical conduct in code organizations while climate-based dimensions were more strongly associated with observed unethical conduct in non-code organizations. Ethical culture and ethical climate-based factors influenced organizational commitment similarly in both types of organizations. Normative implications of the study are discussed, as are implications for future theorizing, research and management practice. (shrink)

This paper elaborates on the idea of the epistemology of ignorance developed in Charles Mills’s work beginning in the 1980s and continuing throughout his writings. I I argue that his account developed initially from experiences of racism in north America as well as certain methods of organizing within parts of the Caribbean left. Essentially the epistemic practice of ignorance causes knowers to discredit or push away knowledge they in fact have. Wrong beliefs, known by some as ‘alternative facts’, have proliferated lately in important areas of human life, including social, political, and public health domains. This can be and has been damaging. This brief article proposes an epistemological category classification of these wrong beliefs, with the following mappings: a) ‘No-Information’ marked by willful blindness produces ‘Empty Beliefs’; b) ‘Mis-Information’ yields ‘Mis(taken) Beliefs’; and c) ‘Dis-Information’ predicated on blatant distortions produces ‘Dis(torted) Beliefs’. Anthropologists have provided rich field descriptions of the norms and conventions governing behavior and interactions in small-scale societies. Here, we add a further dimension to this work by presenting hypothetical moral dilemmas involving harm, to a small-scale, agrarian Mayan population, with the specific goal of exploring the hypothesis that certain moral principles apply universally. We presented Mayan participants with moral dilemmas translated into their native language, Tseltal. Paralleling several studies carried out with educated subjects living in large-scale, developed nations, the (...) Mayan participants judged harms caused as the means to a greater good as more forbidden than harms caused as a side-effect (i.e., side-effect bias). However, unlike these other populations living in large-scale societies, as well as a more educated and less rural Mayan comparison group, the target rural Mayan participants did not judge actions causing harm as worse than omissions (i.e., omission bias). A series of probes targeting the action-omission distinction suggest that the absence of an omission bias among the rural Mayan participants was not due to difficulties comprehending the dilemmas, using the judgment scale, or in attributing a greater causal role for actions over omissions. Thus, while the moral distinction between means and side-effect may be more universal, the moral distinction between actions and omission appears to be open to greater cross-cultural variation. We discuss these results in light of issues concerning the role of biological constraints and cultural variation in moral decision-making, as well as the limitations of such experimental, cross-cultural research. Abstract‘Cultural racism’ is central to understanding racism today yet has receded into the background behind the focus on attitudinal racism. Even the turn to structural racism is largely circumscribed to inclusion without substantive challenge to existing processes or profit margins. When portions of the racist public are targeted, it is often the least elite members of society. Without question, the concept of cultural racism requires some clarification, but it will help bring the continued influence of colonialism forward and reveal the (...) alibis given in mainstream and elite circles that justify exclusion, resource extraction, and domination. The meaning of dignity in health care has been primarily explored using interviews and surveys with various patient groups, as well as with health care practitioners. Philosophical analysis of dignity is largely avoided, as the existing philosophical literature is complex, multifaceted and of unclear relevance to health care settings. The aim of this paper is to develop a straightforward philosophical concept of dignity which is then applied to existing qualitative research. In health care settings, a patient has dignity when he (...) or she is able to live in accordance with his or her standards and values. Accordingly, health care practitioners respect a patient's dignity when they refrain from transgressing the patient's standards and values, or refrain from forcing the patient to transgress his or her standards and values. This concept is shown to explain and illuminate most of the key qualitative findings. It therefore provides a more coherent and synthesised concept of dignity in health care. (shrink)

Abstract:Previous research has identified multiple approaches to the design and implementation of corporate ethics programs (Paine, 1994; Weaver, Treviño, and Cochran, in press b; Treviño, Weaver, Gibson, and Toffler, in press). This field survey in a large financial services company investigated the relationships of the values and compliance orientations in an ethics program to a diverse set of outcomes. Employees’ perceptions that the company ethics program is oriented toward affirming ethical values were associated with seven outcomes. Perceptions of a compliance (...) orientation were associated with four of these outcomes. The interaction of values and compliance orientations was associated with employees’ willingness to report misconduct. In general, a values orientation makes a greater unique contribution to the measured outcomes when compared to a compliance orientation. (shrink)

While models of business ethics increasingly recognize that ethical behavior varies cross-culturally, scant attention has been given to understanding how culture affects the ethical reasoning process that predicates individuals' ethical actions. To address this gap, this paper illustrates how culture may affect the various components of individuals' ethical reasoning by integrating findings from the cross-cultural management literature with cognitive-developmental perspective. Implications for future research and transnational organizations are discussed.

Abstract:This paper outlines three conceptions of the relationship between normative and empirical business ethics, views we refer to asparallel, symbiotic, andintegrative. Parallelism rejects efforts to link normative and empirical inquiry, for both conceptual and practical reasons. The symbiotic position supports a practical relationship in which normative and/or empirical business ethics rely on each other for guidance in setting agenda or in applying the results of their conceptually and methodologically distinct inquiries. Theoretical integration countenances a deeper merging ofprima faciedistinct forms of (...) inquiry, involving alterations or combinations of theory, metatheoretical assumptions, and methodology. This paper summarizes the findings of a three-year exploratory qualitative study of teenage childbearing in 20 low-income multigeneration black families. Teenage childbearing in these families is part of an alternative life-course strategy created in response to socioenvironmental constraints. This alternative life-course strategy is characterized by an accelerated family timetable; the separation of reproduction and marriage; an age-condensed generational family structure; and a grandparental child-rearing system. The implications of these patterns for intergenerational family roles are discussed.

This paper delineates the normative and empirical approaches to business ethics based upon five categories: 1) academic horne; 2) language; 3) underlying assumptions; 4) theory purpose and scope; 5) theory grounds and evaluation criteria. The goal of the discussion is to increase understanding of the distinctive contributions of each approach and to encourage further dialogue about the potential for integration of the field.

Stakeholder theory has largely been anthropocentric in its focus on human actors and interests, failing to recognise the impact of nonhumans in business and organisations. This leads to an incomplete understanding of organisational contexts that include key relationships with nonhuman animals. In addition, the limited scholarly attention paid to nonhumans as stakeholders has mostly been conceptual to date. Therefore, we develop a stakeholder theory with animals illustrated through two ethnographic case studies: an animal shelter and Nordic husky businesses. We focus (...) our feminist reading of Driscoll and Starik’s (J Bus Ethics 49:55–73, 2004) stakeholder attributes for nonhumans and extend this to include affective salience built on embodied affectivity and knowledge, memories, action and care. Findings reveal that nonhuman animals are important actors in practice, affecting organisational operations through human–animal care relationships. In addition to confirming animals are stakeholders, we further contribute to stakeholder theory by offering ways to better listen to nontraditional actors. (shrink)

It may appear that there are grounds for an alliance between opponents of enhancement and disability advocates. People from both camps condemn parents who aspire to improve the physical and psychological traits their children would otherwise be born with, a condemnation often expressed as an accusation of eugenics. Despite these superficial appearances, the author will argue that disability advocates have nothing to applaud in Michael Sandel’s critique of enhancement, which is based on false and sometimes pernicious claims about the value (...) of ‘normal’ human beings. However, they will also argue that disability advocates fail to provide convincing reasons for condemning parental decisions to avoid or eliminate certain traits their children would otherwise be born with. Contrary to what disability advocates and opponents of enhancement suggest, it is often a violation rather than an instantiation of parental virtue to abandon judgements about whether one’s children’s biological givens should be changed. Senior managers are important to the successful management of ethics in organizations. Therefore, their perceptions of organizational ethics are important. In this study, we propose that senior managers are likely to have a more positive perception of organizational ethics than lower level employees do largely because of their managerial role and their corresponding identification with the organization and need to protect the organization’s image as well as their own identity. By contrast, lower level employees are more likely to be cynical (...) about the organization’s ethics. In order to compare senior managers’ and lower level employees’ perceptions of ethics in the organization, we surveyed randomly selected senior managers and lower level employees in three firms. We found that perceptions of ethics in the organization differed predictably across levels, with senior managers’ perceptions being significantly more positive and lower level employees’ perceptions being more negative.
